Florida Republicans at Odds With Their Leader

And now it has become a problem, some of his fellow Republicans say.

?The governor doesn?t understand there is a State Constitution and that we have three branches of government,? said State Senator Mike Fasano, a Republican from New Port Richey who upset Mr. Scott with rough handling of his staff during a testy committee hearing. ?They are talking about the attitude that he is still the C.E.O. of his former health care corporation, and that is not going to work in this state, in Tallahassee, in my district. The people believe in three branches of government.?

Republican lawmakers in Florida were hoping for a smoother transition. Instead, they say, they got top-down management from a political novice.

With the Legislature convening on Tuesday for a potentially arduous two-month session that is bound to usher in major cuts in spending and jobs and radical changes to education, pensions, unemployment benefits and Medicaid, the governor will be tested on a broader, more public scale. Florida faces an estimated $3.6 billion budget shortfall this year and has a stubborn 12 percent unemployment rate.

?I think there have been some understandable growing pains because government doesn?t function like a corporation,? said Speaker Dean Cannon, a Republican from central Florida, taking a more measured tone than Mr. Fasano.

?I like Governor Scott a lot as a person and a leader,? Mr. Cannon said. ?I think he?s going through the understandable adjustment of the transition from campaigning to governance.?

In his first two months in office, the governor has irritated the State Senate?s powerful Budget Committee chairman by selling two state jets without legislative permission, a constitutional no-no. The governor wanted the sale done quickly (he uses his own plane), and he succeeded.

He annoyed the ambitious Senate president, as well as a host of leaders in conservative states, by trying to kill off a database to track the fraudulent distribution of addictive prescription drugs before it was up and running. He did so without consulting lawmakers, calling the monitoring system an invasion of privacy.

Most recently, Mr. Scott rejected $2.4 billion in federal stimulus money to build a high-speed rail line from Tampa to Orlando, which he saw as too big a financial drain on state taxpayers in the long term.

His refusal to take the money prompted new bouts of discord; a staunch conservative Republican from central Florida joined forces with a Democrat in filing a lawsuit last month, and 26 lawmakers signed a letter to the federal transportation secretary urging him to basically ignore the governor and send the money anyway. (The State Supreme Court ruled in Mr. Scott?s favor on Friday.)

As State Senator Arthenia L. Joyner, a lawyer and the Democrat who took Mr. Scott to court, put it at a news conference about the suit: ?It?s necessary at this time, I think ? because our governor?s new ? to let him know this is not a monarchy. He?s not a king. This is a democracy.?

Mr. Scott?s go-it-alone style of governing was on display vividly last month when he chose to unveil his two-year budget 200 miles from Tallahassee, in the rural town of Eustis, at a rally jammed with Tea Party supporters. Mr. Scott, who wants to promote business in the state and drastically reduce the government?s reach, proposes slashing $4.1 billion in spending and cutting property and corporate income taxes.

?Let?s start with the obvious: we can?t spend more than we take in,? Mr. Scott told the cheering crowd. ?We take in enough from hardworking Floridians. We don?t need to take any more.

?Critics have said you can?t cut taxes now,? he continued. ?They are wrong. We will cut taxes now, and they should cut taxes now. Things will not improve until we grow private sector jobs, not government jobs.?

Lawmakers, though, are decidedly less optimistic about Mr. Scott?s budget plan, and even less enthusiastic about his uncongenial approach to Tallahassee. From the start, the relationship between powerful state Republicans and Mr. Scott was strained.

Republican leaders supported Mr. Scott?s primary opponent, Bill McCollum, and poured money into negative advertising that portrayed Mr. Scott as untrustworthy and fraudulent. Mr. Scott resigned in 1997 as the head of Columbia/HCA, the nation?s largest hospital chain, amid an F.B.I. investigation. That inquiry eventually led to $1.7 billion in criminal and civil penalties for Medicare fraud.

Some companies actually want their employees to blog, tweet, and update their social-networking profiles at work?as long as they're doing it on corporate-purchased software.

Three years ago, the information management company EMC began encouraging employees to spend time on internal social networks discussing their extracurricular interests. "We have people talking about photography, and art, rock climbing?you name it," says Jamie Pappas, whose title speaks volumes: she is manager of enterprise social-media engagement strategy.

EMC had something in mind beyond connecting all its motorcycle enthusiasts. The management wanted to test new "social business software" from Jive, a company that runs online forums and social-networking and collaboration software for businesses.

"The thinking really was that employees really want to come together around a topic, and they're worried about saying something wrong if it's about a [work] project," Pappas says. "So those social conversations were sort of like icebreakers. It helped people get in there and then feel comfortable jumping into the business conversation."

When companies get too big, opportunities for collaboration can diminish. Individual employees looking for a colleague with expertise on a particular topic can struggle to find the right person. E-mail is little help: employees' in-boxes are deluged. Corporate memory of sales leads or customer service solutions can get buried.

In hopes of cutting through the noise, Jive offers a wide-ranging platform for collaboration, competing with the likes of IBM and Oracle. It offers applications to connect colleagues and projects the way Facebook, Twitter, and Web forums connect fan bases and friends. Employees set up profiles, blogs, groups, and Facebook-style "walls." All this interaction happens behind the corporate firewall but is accessible by internal search programs. In turn, these programs work with software that companies already have in place, including customer relationship management (CRM) programs, Microsoft's Sharepoint, and software for human resources, supply chain management, and accounting.

At EMC, instead of starting long e-mail threads, employees can check updates about a project on a Jive page, search for relevant materials, and download the files as they need them. Sales representatives looking for insight about a competitor can query the "competitive community" on EMC's internal social network and get an answer as they walk to a client meeting, Pappas says. The company also now uses Jive's tools externally, to augment user-support forums and to create community or "affinity" pages for clients that use EMC software.

Collaboration tools with origins in the consumer world, such as instant messaging, have often met with resistance from IT departments. But Stowe Boyd, an analyst and advisor to companies building such applications, says business-focused social-networking software is growing much faster than earlier tools. Christopher Morace, Jive's senior vice president of business development, credits the increased popularity of Facebook. When Jive started selling its social business software in 2007, some potential customers were wary of adding more tasks to the workday. But now, Morace says, he doesn't need to explain that with these tools, a person can realistically keep track of multiple conversations and engage hundreds of contacts.

Jive hopes to become something like a Facebook in business?a widely used platform on which many kinds of applications are hosted. The company is building a developer community and allowing third parties to write apps to work with its software. "When push comes to shove," Morace says, "when this market becomes really competitive, we decided we are really good at being the modern platform."

Obama Clears Way for Guantánamo Trials to Resume

Mr. Obama said in a statement that he remained committed to closing Guantánamo someday and to charging some terrorism suspects in civilian criminal courts. But Congress has blocked the transfer of prisoners from Guantánamo to the United States for trial, frustrating the administration?s plan to hold civilian trials for Khalid Shaikh Mohammed, the self-professed chief plotter of the Sept. 11 attacks, and others accused of terrorism.

Officials declined to say whether Mr. Mohammed would be scheduled for a military commission or would await a trial in federal court if Congress lifts its prohibition.

Separately, for detainees who will not get trials, Mr. Obama set out new rules in an executive order Monday requiring a review of their status within a year and every three years after that to determine whether they remain a threat, should be scheduled for a military trial or should be released. The order also requires compliance with the Geneva Conventions and the international treaty that bans torture and inhumane treatment.

Mr. Obama said in a statement that from the beginning of his administration, ?the United States has worked to bring terrorists to justice consistent with our commitment to protect the American people and uphold our values.? He said the new procedures, which had been forecast in news reports, ?broaden our ability to bring terrorists to justice, provide oversight for our actions, and ensure the humane treatment of detainees.?

Administration officials declined to discuss individual cases, but one senior official said he expected new charges to be brought against detainees within days or weeks. A second official said the administration was committed to bringing ?9/11 plotters to justice? but did not explain how that might occur. Among detainees believed most likely to face a military commission soon is Abd al-Rahim al-Nashiri, a Saudi accused of planning the bombing of the American destroyer Cole in Yemen in 2000. He was subjected to waterboarding, which could open the way to assertions by the defense that he was tortured, complicating any trial.

Civil liberties advocates, who have long been critical of Guantánamo, expressed disappointment that the military system remained in place more than two years after Mr. Obama took office.

?This is a step down the road toward institutionalizing a preventive-detention regime,? said Elisa Massimino, president of Human Rights First. ?People in the Mideast are looking to establish new rules for their own societies, and this sends a mixed message at best.?

Still, some lawyers for detainees said the executive order might speed the release of men imprisoned for years without trial, either after a review, a trial or a plea agreement.

?If this leads to a meaningful process and a conclusion that a person should be released, that would be an improvement,? said Joseph Margulies, a law professor at Northwestern who has represented Guantánamo prisoners and written a book on the detention camp.

Mr. Obama had suggested that he might go to Congress for a law governing indefinite detention. Human rights groups were relieved that he instead issued an executive order, which is easier to undo in the future. They were also pleased that Mr. Obama limited his order to 172 prisoners currently held at Guantánamo rather than extending it to any future detainees.

Karen J. Greenberg, director of the Center on Law and Security at New York University, said she was pleased that the executive order left open the possibility that prisoners might be transferred to the United States at some point and that the review panels would include representatives from the Departments of State, Justice and Homeland Security as well as Defense and the director of national intelligence.

But Ms. Greenberg added that the order ?does nothing to address the underlying moral and philosophical issues at stake at Guantánamo.?

Republican lawmakers criticized the president for not working with Congress on a law that would govern the prosecution and detention of terrorism suspects, even as they applauded him for rescinding his ban on military commissions.

?I am disappointed the White House chose to put another Band-Aid on this problem, rather than working with Congress to develop the comprehensive and long-term legislative framework we need,? said Representative Mike Rogers, a Michigan Republican and chairman of the House Intelligence Committee.

But several Democrats rallied behind the White House, saying the executive order would guarantee timely trials for the remaining detainees, thus avoiding the risk that courts would just order their release.

?The executive order announced today helps clear the way to charge and try our enemies,? said Representative Adam Smith of Washington, the ranking Democrat on the House Armed Services Committee.

Administration officials insisted that Mr. Obama had not retreated from his pledge to close Guantánamo Bay, despite difficulties in transferring prisoners or trying them in federal courts. Detainees have been released to their home countries and to other countries as varied as Germany and Palau, and a senior official said that process would continue.

The new procedures for military commissions guarantee detainees access to a legal representative and to a broader range of classified information, which the detainee?s representative can use to argue his client?s case before the review board.

The administration also said it would ask for Senate approval to sign on to two additional protocols of the Geneva Conventions governing humane treatment and fair trials for prisoners held in wartime. Secretary of State Hillary Rodham Clinton said the step would ?reaffirm the determination of the United States to treat humanely all detainees in our custody.?

Since the beginning of the Obama administration, the Defense Department has transferred 67 detainees from Guantánamo Bay to 24 destinations, including the transfer of 40 detainees to third countries, according to government figures. But the active status of Al Qaeda?s affiliate in Yemen, the home of the largest remaining group of detainees, has dissuaded the administration from sending prisoners there. And most countries have agreed to accept only tiny numbers of Guantánamo detainees.

Today?s total of 172 detainees is down from 242 when Mr. Obama entered office. About 500 detainees were released by the Bush administration.

Microsoft to pay Nokia over $1 billion in smartphone deal

Microsoft, according to BusinessWeek, will be paying the Finnish company Nokia more than $1 billion in their industry-shaping smartphone deal.

The deal, under which Nokia will use the Windows Phone 7 OS, was seen as a coup for Microsoft, and a potential blunder by Nokia. Nokia has long used its own proprietary software, meaning the partnership was a sea change for the company.

The $1 billion plus dollars will go to ?promote and develop Windows-based handsets? by Nokia, according to the report.

This new disclosure of information, coming not from a press release, but through leaks, is surprising. After the deal was announced, speculation ran wild that the agreement would involve several billions of Microsoft dollars being shipped to Nokia. Then comments from Nokia?s CEO seemed to run contrary to the idea.

Now, with this new information, a figure slightly above a single billion dollars seems to be gospel.

The deal itself will involve Nokia paying Microsoft a per-device fee to use the OS, opening a potential rich revenue stream for the Microsoft mobile division for the future. Provided the phones sell, then Microsoft would not only be growing its market share, but also its revenues in a very direct and simple fashion.

With the final figure range revealed, Nokia?s decision to not adopt Google?s Android seems simpler: Windows Phone 7 came with a check.

Of course, Microsoft can afford the billion dollars to grab mobile market share, something that it has been shedding for years. With the Nokia deal, Microsoft has a chance to truly explode its new platform around the world. If it can do so, and regain its position near the top of the smartphone world, the billion dollar pricetag will be seen as a strategic investment and nothing more.

On the other hand, if the Nokia deal goes either south or sideways, Microsoft will have, in effect, ejected a billion greenbacks from its coffers for a nil return.

Whatever the case, with Microsoft?s cash and software, and Nokia?s still massive handset market share, both of the companies are praying for a rebound. If they get it, they will both become richer. If not, Microsoft will survive, but Nokia might be both broken, and broke.

Beware: Twitter scam app claims to show who visits your profile. It can?t.

A Twitter scam app which claims it help you see the people accessing your profile is proliferating across Twitter today, with users being duped into granting access to their Twitter accounts to spread the scam even wider.

The app, named ?See Wh0 Viewed Y0ur Pr0file? requests access to a users? Twitter account via OAuth (an authentication platform that won?t share your sensitive information), sending out two tweets once it has been approved:

WOW! You can see WHO VISITS your TWITTER profile. That?s cool! :) ? http://bit.ly/tweetviewer

The second:

I just viewed my TOP20 Profile STALKERS. I can?t believe my EX is still checking me every day ? http://bit.ly/tweetviewer

If you see these tweets, DO NOT click them, instead warn the person you follow that they may have granted access to an app that could be used to tweet scam messages. If you do click the link, make sure you do not allow the application to have access your account:

The scam began circulating last week. If you notice the name of the application, the developers have replaced the correct spelling with zeros. When it first appeared, the application was known ?See Who Viewed Your Profile? but Twitter quickly disabled the app. Today?s inconvenience is being caused by the same application, but with a slightly altered name.

In a fifteen minute period, the scam app sent out 6972 tweets from Twitter user accounts:

If you have found you accidentally granted access to this application, you can remove it easily. Make sure you are logged into your Twitter account, click Settings and then Connections, making sure to revoke the application?s access.

Scams such as this will make their way across Twitter, just remember to be vigilant. Do not click links you don?t trust and never grant access to a Twitter application unless you are 100% sure it is safe.

Twitter?s Safety team looks to be on the case and will likely have the application removed soon. Del Harvey, a member of the Safety team, tweeted the following message just minutes ago:
